Intent

 

To exempt a client or third party from the requirement to repay a benefit in appropriate circumstances.

 

Policy

 

No Repayment of Financial Benefits (e.g. living allowance or child supplement)

Repayment of an overpayment may be waived if it is determined that there are appropriate circumstances and the amount required to be repaid is not yet a debt.  For example, no repayment of an overpayment may occur in situations where the assessed overpayment was the result of an exceptional circumstance beyond the client’s control or knowledge.

No Repayment of Health Benefits and Personal Benefits

Repayment of a health benefit or personal benefit may be waived if a client unknowingly received a benefit to which the client, their cohabiting partner or dependent child was not entitled.
